OFFICIAL RULES
Sweepstakes Period: This Sweepstakes will commence on October 13, 2025 and end on October 31, 2025.
PRELIMINARY INFORMATION: NO PURCHASE NECESSARY. A purchase will not improve your chances of winning. Void where prohibited by law. Open ONLY to California Residents who are eighteen years of age and older (“Eligible Entrants”). The Bellwether Win Tickets Sweepstakes (“Sweepstakes”) will begin on October 13, 2025 and end on October 31, 2025 (“Sweepstakes Period”). All times in the Sweepstakes refer to Pacific Standard Time. Odds of winning depend upon the number of Eligible Entries received (defined below). The Sweepstakes is subject to all applicable federal, state and local laws.
SPONSOR & ADMINISTRATOR: The Sponsor of the Sweepstakes is Third Pulse, LLC, a California Limited Liability Company d/b/a The Bellwether LA (“Administrator”, or “Sponsor”), 333 S. Boylston Street, Los Angeles, California 90017.
ELIGIBILITY: Open only to natural persons eligible to participate. “Eligible” means natural persons who are: (i) permanent, legal United States (“U.S.”) residents; (ii) reside in and are physically located and residing in the State of California; and (iii) eighteen (18) years of age or older as of the start date of the Sweepstakes Period. Entrants must have a valid U.S. social security number and/or a valid U.S. personal tax identification number. Officers, directors, shareholders, members, managers, employees, agents or representatives of Sweepstakes Entities (as defined below), and their immediate family members (spouses and/or parents, children, and siblings, and their spouses, regardless of where they reside), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter or win the Sweepstakes. “Sweepstakes Entities”, as referenced herein, shall include the Sponsor (defined above), Another Planet Entertainment, LLC and each of the parent, subsidiary, affiliated and related persons and entities, and all of the officers, directors, shareholders, members, managers, employees, agents, and representatives, of each of the foregoing, including their administrative, advertising, and promotion agencies, and any other person or entity involved in the development, administration, promotion, or implementation of the Sweepstakes. This restriction is binding on all successors and assigns of Sweepstakes Entities.
HOW TO ENTER: Here is how you enter the Sweepstakes.
To Enter Without Purchase or Any Other Conditions
No purchase is necessary to enter and to potentially win. During the Promotion Period, visit [entry URL/link] and follow the instructions to complete and submit the entry form. To enter without a purchase, please fill out the form (“Entry Form”) which includes your name, contact address, email address and phone number, and email it to: [INSERT NAME, EMAIL ADRESS, ETC. FOR SENDING FORM].
Any person who submits an entry as set forth above, such entry will be referred to herein individually as an “Entry” or collectively as “Entries”. Persons who enter the Sweepstakes, may be referred to herein as “Entrant” or collectively “Entrants”.
An eligible entry (“Eligible Entry”) is an entry that conforms with the way to enter the Sweepstakes as set forth above.
Entries must be received by 1:00 p.m. PT on October 31, 2025 , to be eligible for the Sweepstakes. One Entry per Eligible person during the Sweepstakes Period. All required Entry information must be completed in full. Any attempted use of a form of Entry other than as described herein is void. Entries generated by a script, macro, or other automated means will be disqualified.Entries that are incomplete, garbled, corrupted, or unintelligible, for any reason, including, but not limited to, computer or network malfunction or congestion, are void, and will not be accepted. If there is a dispute as to the identity of an Entrant who made a potentially winning Entry, Sponsor will, in its discretion, resolve the issue.
PRIVACY: Any personal information supplied by Entrants to Sponsor and Administrator will constitute consent to use such information as set forth herein and as set forth under the privacy policy posted on the Website for The Bellwether LA.
WINNER SELECTION AND NOTIFICATION: On or about November 3, 2025 at Noon (12:00 p.m.) PT, one (1) potential Prize (defined below) winner (“Winner”) will be selected in a random drawing by representatives of Sponsor from all Eligible Entries received during the Sweepstakes Period. For clarity, to win the Entrant must fill out the form with their name and contact information and return it by email to the address indicated above. Sponsor will attempt to notify the potential Winner at the phone number and/or email address submitted at the time of Entry. Sponsor is not required to contact any potential Winner more than once. As a condition of claiming the Prize, the potentialWinner will be required to execute and return a Winner’s Affidavit and Release (the “Release”), in the form of Exhibit “A”. Each Winner may designate a guest to share the Prize (defined below) (“Guest”). As a condition of sharing the Prize with a Guest, the Guest will be required to execute and return a Guest’s Affidavit and Release (the “Guest Release”), in the form of Exhibit “B”. The Release and the Guest Release are referred to collectively herein as the “Releases”. The Releases must be executed, returned to, and received by Sponsor as soon as possible, but no later than noon (12:00 p.m.) PT on November 7, 2025. Non-compliance with this time period for receipt, by Sponsor, of the fully executed Releases will result in disqualification and forfeiture of the Prize. Sponsor reserves the right to disqualify any Entrant, potential Winner, Winner or Winner’s selected Guest, as determined by Sponsor, in its sole discretion, if any potential Winner cannot be reached, if Winner or Guest are found to be ineligible, or cannot, or do not comply with these Official Rules. Sponsor further reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes in whole or in part, in the event of fraud, technical or other difficulties or if the integrity of the Sweepstakes is compromised, without liability to any Entrant, potential Winner, or potential Guest. In the event that Sponsor exercises the right to disqualify a potential Winner, Sponsor may, time permitting, and in its sole discretion, select an alternate Winner by random drawing to be the potential Winner of the Prize from the remaining Eligible Entries.
ODDS: Odds of winning depend on the total number of Eligible Entries received.
PRIZES: One (1) Prize.
Prize: There will be one (1) prize (the “Prize”) awarded to one (1) Winner. The one (1) Winner will be awarded one (1) Prize, which consists of: Two Tickets to a Show at the Bellwether LA of the Winner’s choice. The Estimated Retail Value (“ERV”) of the Prize for a Winner and a Guest is in the range of $50.00 to $200.00 depending on which show is selected by Winner.If Winner does not elect to share the Prize with a Guest, then the Prize shall consist of: One ticket to the show of Winner’s choice at The Bellwether. The combined ERV of the Prizefor a Winner without a Guest is $25.00 to $100. The Actual Retail Value (“ARV”) of the Prize may vary depending on the show. Any difference between the stated ERV and the ARV of the Prize will not be awarded. Only the Prize stated in these Official Rules is available to be won. Tickets awarded are subject to terms and conditions as specified on the ticket by the issuer of the tickets, and cannot be exchanged, redeemed for cash or combined with any other offer. Sponsor will not replace any lost or stolen Prizes nor Prize components. Additional restrictions may apply. Sponsor reserves the right to determine the details of the Prize or substitute a similar prize (or any prize element(s)) of comparable or greater value, for any reason in its sole discretion. All federal, state and/or local taxes and other unspecified expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winner. Winner will receive an IRS 1099 Tax Form for the value of the Prize as set forth above. The Prize cannot be transferred by Winner or by Guest, in whole or in part, nor redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Winner or by Guest. The Prize does not include any transportation to or from Los Angeles, the location of The Bellwether LA, nor any transportation in and around Los Angeles, including but not limited to, transportation to or from the venue, nor any transportation fees, costs or accommodations other than those expressly stated herein. Winner will be responsible for any costs and/or expenses related to the receipt or use of any part of Prize not expressly covered. The Prize may only be used and redeemed by the Winner and a Guest whom Winner may select to share in the use and enjoyment of the Prize, subject to the conditions set forth herein and in the Releases which Winner and Guest must execute in the forms provided and attached as Exhibit “A” and Exhibit “B”. If Winner does not designate a Guest on the Release, the guest benefits of the Prize will be forfeited. Guest may not be a minor.
CONDITIONS: By entering the Sweepstakes, each Entrant agrees for Entrant, and on behalf of Entrant’s Guest(s), heirs, successors, executors, and administrators: (a) to release and hold harmless Sweepstakes Entities from any liability, loss, litigation, damage or liabilities of any kind or nature that may occur, directly or indirectly, however caused, and arising from such Entrant’s participation in the Sweepstakes and, if selected as a Winner or as a Guest, from his and/or her acceptance, possession, use, or misuse of the Prize, or any portion thereof (including any travel related thereto), including but not limited to any illness, injury, or death; (b) to indemnify Sweepstakes Entities from any and all liability resulting or arising from the Sweepstakes and to acknowledge that Sweepstakes Entities have neither made, nor are in any manner responsible nor liable for, any warranty, representation, or guarantee, express or implied, in fact or in law, in connection with the Prize, including warranties provided by the individuals and/or entities that are ultimately supplying the Prize, including, but not limited the Sponsor; (c) that if selected as a Winner or as a Guest, to consent to the use and exploitation of his/her name, image, likeness, biographical information (“Publicity Rights”), and any statements attributed to Winner or to Guest in perpetuity for the advertising, marketing and promotion of Sponsor and its live entertainment business, including without limitation, use and exploitation of such Publicity Rights in Sponsor’s newsletter, Sponsor’s social media, the Sweepstakes page, and Sponsors’ Website. Such use and exploitation shall be permitted without compensation in addition to the Prize; (d) that if Winner or Guest create any photographs, videos, film or other audio-visual material (“Winner Content” and “Guest Content”) in connection with the Sweepstakes, being selected as a Winner or as a Guest, the Prize or attendance at the show at The Bellwether LA, Winner and Guest grant an irrevocable, non-exclusive, fully paid up, worldwide license, in perpetuity, to Sponsor to use and exploit any such Winner Content and Guest Content, to advertise, promote, and market, Sponsor and its live entertainment business, and to make such Winner Content and Guest Content available to Sponsor, at all reasonable times and places, in any reasonable manner which allows Sponsor to access the foregoing, for use and exploitation as set forth herein without further compensation; (e) that exploitation of Publicity Rights, Winner Content or Guest Content by Sponsor shall be permitted in any or all forms and formats of media whether now known or hereafter created, developed or devised; and (f) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Sweepstakes itself, and to be bound by all decisions of the Sponsor regarding the administration of the Sweepstakes, which are binding and final. Sponsor reserves the right to disqualify any Entrant or Winner or potential Guest, as determined by Sponsor in its sole discretion, for failure to comply with these Conditions (the foregoing paragraph and clauses (a) through (f), are collectively referred to herein as the “Conditions”).
RELEASE: As an added condition of receiving the Prize, separate Releases must be executed by the Winner and the Winner’s accompanying Guest (attached as Exhibit “A” and “B”). The Releases must be executed by the Winner and the Guest, certifying eligibility, fulfillment of all Conditions (set forth above) and generally releasing Sweepstakes Entities from liability. By participating, each Entrant indemnifies, releases and agrees to hold harmless Sponsor, and all other Sweepstakes Entities, and each of their respective parent, partners, subsidiaries, affiliated and related persons and entities, divisions, prize suppliers, advertising and promotion agencies, and the directors, officers, shareholders, managers, members, agents, representatives, employees, successors and assigns of any of the foregoing (collectively “Released Parties”) from any and all liability arising from participating in the Sweepstakes (including but not limited to risk of illness, injury or even death arising directly or indirectly, in whole or part) and from any Sweepstakes-related activity and/or the acceptance, receipt, possession or use/misuse of the prize (as applicable). Without limiting the foregoing, Released Parties make no representation, warranty or guarantee of any kind regarding the Prize or any part thereof; this includes but is not limited to the warranty of merchantability or fitness for intended purpose. Except where prohibited by law, acceptance of a Prize constitutes winner’s agreement to the use of his/her name, address (city, state), likeness, image, voice, photograph or other indicia of persona and/or statements regarding the Sponsor or the Sweepstakes for advertising, publicity and trade purposes by Sponsor and its designees, without further compensation or any notice or approval of any kind. The Releases broadly extend to all claims, causes of action, losses, damages or liabilities of any kind or nature in existence from the beginning of time, through and including the commencement of the Sweepstakes Period, until the conclusion of the experience of any benefits of the Prize by the Winner or Guest, (collectively, the “Release Period”) and will include without limitation any and all rights that Winner and Guest may have had, or presently has, with respect to the provisions of Section 1542 of the California Civil Code (“Section 1542”). Winner and Guest, as a condition of receiving the Prize, will expressly waive all benefits and protections of Section 1542, which provides in full:
A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.
ADDITIONAL TERMS: Sponsor reserves the right to permanently disqualify from the Sweepstakes any person it believes has intentionally violated these Official Rules. Any attempt to deliberately damage the Sweepstakes, or the operation thereof, is unlawful, and subject to legal action by Sponsor, who may seek damages to the fullest extent permitted by law. The failure of Sponsor to comply with any provision of these Official Rules due to the failure of Entrant’s electronic device, mobile device, internet and/or mobile service provider, or a Force Majeure event will not be considered a breach of these Official Rules. A “Force Majeure event is an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, city-wide black-out or brown-out, labor strikes, an epidemic or pandemic, actions of governmental authorities or other event outside of the reasonable control of Sponsor (excepting compliance with applicable codes and regulations). Sweepstakes Entities assume no responsibility for any injury, or damage to Entrants’, or to any other person’s computer, relating to, or resulting from, entering or downloading materials or software in connection with the Sweepstakes. Sweepstakes Entities are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsor reserves the right to cancel, modify, or suspend the Sweepstakes, or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension of the Sweepstakes, Sponsor reserves the right to select Winner in a random drawing from among all eligible Entries received prior to the time of the event warranting such cancellation, modification, or suspension. Notice of such cancellation, modification, or suspension will be posted on the Sponsor’s Website. Sponsor may prohibit any Entrant or potential Entrant from participating in the Sweepstakes, if such Entrant or potential Entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other Entrant, Sponsor, or any of the Sweepstakes Entities; or behaves in any other disruptive manner, and which Sponsor reserves the right to determine in its sole discretion. This Sweepstakes is void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations.
DISPUTES: THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF CALIFORNIA, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN THE CITY AND COUNTY OF SAN FRANCISCO, CALIFORNIA. THE PARTIES ARE REQUIRED TO MEDIATE THEIR DISPUTE BEFORE INITIATING ANY ARBITRATION. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., (“J.A.M.S.”) IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“J.A.M.S. RULES”). THE J.A.M.S. RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN THE STATE OF CALIFORNIA. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE CITY AND COUNTY OF SAN FRANCISCO. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DIRECT DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES, NOR SHALL ANY PARTY BE ENTITLED TO RECOVER ATTORNEY’S FEES, NOR ANY COSTS RELATED TO THE PURSUIT OF A CLAIM, NOR SHALL ANY PARTY BE ENTITLED TO SEEK RESCISSION OF SWEEPSTAKES DOCUMENTS, THIS AGREEMENT, NOR INJUNCTIVE NOR ANY OTHER EQUITABLE RELIEF. COSTS OF MEDIATION AND/OR ARBITRATION WILL BE SPLIT EQUALLY BETWEEN SPONSOR, ON THE ONE HAND, AND WINNER/GUEST, ON THE OTHER HAND.
